MARK A. FOTI, ESQ.
There are various forms of Criminal Mischief. The majority of theses crimes deal with the allegation of damaged property. The value of the allegedly damaged property will result in either misdemeanor or felony charges. In many cases, plea negotiations will revolve around the issue of restitution, but nobody should be required to plea guilty to an offense they did not commit or pay restitution for damage that they are not responsible for. You should be able to consider your options and decide whether you would prefer to resolve your matter with a plea bargain or have your matter taken to trial.  Mark Foti's most recent Criminal Mischief jury trial resulted in a full acquittal in Rochester City Court in August 2011.
